CENTERVILLE -- A concealed-carry weapons permit holder was caught with his pants down after his handgun dropped from its holster, struck the ground, fired one shot and destroyed the toilet he'd just used.

Porcelain shrapnel cut the man's arms, according to a Centerville police news release, but neither he nor anyone else was seriously injured.

Police responded Monday to Carl's Jr. at 385 N. 800 West to reports of a shot fired in the men's bathroom.

A 26-year-old man, who police did not name and did not cite, was carrying a Kahr P40 handgun, according to the release.

"While pulling his pants up, the gun fell out of the holster, striking the floor. When the gun hit the floor, it went off and the bullet struck the toilet, shattering it and sending sharp pieces of porcelain flying," the release states.

The gun owner's small cuts were treated at the scene.

A female employee in the women's bathroom was frightened and complained of chest pain. She, too, was treated at the scene.

Nohemi Lopez was working the counter at the time of the shooting.

"I (didn't) see anything. I really just heard the sounds and that's it," Lopez said. "I was afraid."

Lopez said the store manager went to the bathroom and asked the accidental shooter if he was OK.

Police blamed the gun and style of holster the man used for the accident. They described it as an "inside the pants" holster and said it was not secure.

"In this case, it appears that the accident would have been prevented if the man had used a secure holster," the release states. "A good-quality firearm also should not fire if it is dropped."

Police took custody of the weapon "for safekeeping," according to the release.

When asked whether the gun was obviously faulty after inspection, Centerville Police Lt. Paul Child said he did not know.

When asked if the man may have cocked the gun prior to its firing or might otherwise have been playing with it, Child said, "I've kinda wondered the same thing."

Child said no investigation is planned.
