New Mexico Restaurant Carry Legislation Needs Your Help!

State Representative John Heaton (D-Carlsbad) has introduced House Bill 105 (http://www.nmlegis.gov/lcs/_session.aspx?chamber=H&legtype=B&legno=%20105&year=09), a measure that would permit Concealed Handgun Licensees to protect themselves in establishments that are licensed to dispense alcoholic beverages for consumption on the premises IF the establishment derives more than 60% of their annual gross receipts from the sale of food.



The legislature passed House Bill 588 in 2007 to open up grocery and convenience stores, which sell alcohol for consumption off the premises, to Concealed Handgun Licensees; NRA supported that bill and backs this latest effort to allow them to lawfully enter restaurants.



HB 105 has been referred to the House Business & Industry Committee. Please contact the committee members listed below at their capitol offices and urge them to support HB 105. Remind them that it is already unlawful to carry a firearm while under the influence of alcohol, and that Concealed Handgun Licensees should not be denied their right to self-defense just because other patrons of a dining establishment can legally choose to consume alcoholic beverages on the premises.

I have been informed that HB 105 was passed by the House Business and Industry Committee yesterday. This is a good first step, but there is a long way to go before it becomes law. I will keep you all posted.

On Tuesday, February 3, the House Business & Industry Committee unanimously approved House Bill 105, NRA-backed legislation sponsored by State Representative John Heaton (D-Carlsbad).

HB 105 (http://www.nmlegis.gov/Sessions/09%20Regular/bills/house/HB0105.html)would permit Concealed Handgun Licensees to protect themselves in establishments that are licensed to dispense alcoholic beverages for consumption on the premises IF the establishment derives more than 60% of their annual gross receipts from the sale of food. Thanks go out to the supporters of the measure who attended the hearing and provided clear, concise, and compelling testimony to the committee!

Currently, concealed carry permit holders dining in restaurants that serve alcohol must leave their firearm at home or locked in their vehicle, where it is at risk of being stolen. Despite passing a background check and possessing a state issued permit to carry, law-abiding permit holders are forced to give up their right to self-defense when dining in establishments that serve alcohol. The need for this legislation is clear.

HB 105 now moves to the House Judiciary Committee for consideration. NRA-ILA will keep you posted on the date, time and location of future hearings on the bill. The volume of phone calls and emails in support of HB 105 has been enormous. With the legislative session in full swing and many lawmakers working around the clock with little or no staff assistance, it’s time to target our message for optimum effectiveness!

On Wednesday, the New Mexico Senate approved Senate Bill 608 by State Senator George Munoz (D-4) by a 26-15 vote. This NRA-backed legislation would enable Concealed Handgun Licensees to protect themselves in dining establishments that are licensed to serve alcohol, if more than half of their revenue is generated from food sales.

The bill still has to make it thru the full House and onto the Governor's desk for signature.

P.S.: As of yesterday, there were 1900+ bills awaiting action in the legis.; this is just one of those. With only 7 days left in session, the chances of passage are maybe 50/50; maybe 60/40 at best? No reported position from the Gov. on this but he could still veto it even if it made it to his desk. Depending on language, it could become law upon the Gov's. signing or there could be a specific date. Given the 5-4 vote in Senate committee the other day, this one could be very close!

I have no idea of where things are at the moment. Both bills have been moving forward, but there are a lot of bills and not much time left. As soon as I hear something I will let you know.

It looks like it passed through! If I am reading this correctly, it looks like we will be able to carry in restaurant establishments that serve alcohol. I will confirm as well.

Thank You to Those Who Answered the Call to Action!

The New Mexico Legislature adjourned sine die on Saturday, March 21. Thanks to your phone calls and emails, three NRA-backed measures made tremendous progress through the legislative process, but fell just short of the goal line: Senate Bill 608 authored by State Senator George Munoz (D-4), New Mexico’s restaurant carry legislation, and Senate Bill 507 introduced by State Senator Stuart Ingle (R-27), a bill that would have eliminated the two-hour refresher course for certain Concealed Handgun Licensees. SB 608 and SB 507 each passed two Senate committees, the full Senate, and two House committees -- only to fail to receive consideration by the full House due to a crowded calendar on the last day of session.

House Bill 105, introduced by State Representative John Heaton (D-55), the House version of the restaurant carry bill, passed two House committees and the full House -- only to die in the Senate Judiciary Committee, after it failed to reach a quorum on the last day it was scheduled to consider bills.

NRA-ILA will follow up later this week to give you a list of legislators who were key to the progress we made on these important issues the first-time out. We fully intend to pursue similar measures in future legislative sessions!

Folks there is still time. The Governor can still sign SB 608 and SB 507 IF THEY ARE BROUGHT TO HIS DESK BY FRIDAY at 1200PM. Call Bill Hume at 505-476-2200 and POLITELY URGE him to hand carry them to the Governor.
