Alamogordo has to shell out $21,000, plus attorney fees, because of law enforcement officers trying to protect the public.

Judge Bruce D. Black got it wrong when he decided that Mathew A. St. John, who carried a loaded .45 caliber handgun into the Aviator 10 movie theater last year, has his right of protection against "unreasonable search and seizure" violated.

Police responded to a complaint by another movie attendee who saw this armed man at a showing of "Wanted," a movie about assassins. When police arrived and confirmed that St. John was armed, they asked him to stand with his hands in sight and physically removed him from the dark theater to question him about his weapon.

Although it is legal for St. John to carry a firearm openly in New Mexico, the way law enforcement approaches an armed suspect must be more aggressive for their protection.

The lawsuit against the city was won by the armed man at the movies because of the way police questioned him. First, they confirmed he was armed, then asked him to stand while showing is hands and removed him from the dark theater to investigate his intent with a gun while running a check on the gun's registration.

I don't see how the police erred here. By openly carrying a gun, the perception is that you are willing to shoot your gun. That is why the movie patron complained and police responded. The gun carrier is the threat. A loaded weapon is visually menacing and deadly in an instant. You may have the right to carry a gun to the movies (ridiculous), but you must also be willing to accept that you will be treated differently by police if you are armed.

I hope this case will get national attention that will change our gun laws. It is unsettling to see armed people in public areas. The gun toters do not understand how sinister and threatening they are.

Mr. St. John exemplifies this when he stated that "no one came up to me and complained." Would you approach a man carrying a loaded .45 to complain that he has a gun? No, you would call the police. The question is, will they come? Now that the courts have ruled that it is unlawful for them to investigate an armed man, the majority of unarmed movie attendees will not be protected from people who feel the need to intimidate us into submission even in the dark.

Because of stupid rulings like this, the future for gun control is necessary. By blatantly carrying loaded weapons into crowded public places and frightening the majority of unarmed citizens, gun radicals have overstepped their right to bear arms.

Just because the threats and texts showed up restricted doesn't mean the number it came from can't be found out. If you wanted to file a complaint at your local "friendly" DPS, I'm sure they could contact cell phone carriers and get the information. I mean if you feel comfortable assuming it's only idle threats then leaving it alone may be the best option. But, if you have an apprehension about the threats I'd at least file a complaint to get it on record. Of course, that would be a decision for you to make.
