Ruling on a case from Cook County, the U.S. Supreme Court has turned away a new challenge to a 2005 law that gives gun manufacturers immunity from lawsuits by shooting victims.

The justices refused today to hear an appeal from Hector Adames Jr. to revive his lawsuit against the Beretta U.S.A. Corp. over the accidental shooting death of his 13-year-old son on the Southwest Side of Chicago.
The Illinois Supreme Court threw out the lawsuit, citing the federal 2005 Protection of Lawful Commerce in Arms Act.

Adames' son, Josh, was shot and killed by another 13-year-old boy who found his father's Beretta and removed the magazine containing the ammunition. He pointed the gun at Josh and pulled the trigger, not knowing that a bullet remained in the chamber.

The boy's father was a Cook County correctional officer, and the Beretta was his service gun.

Adames sued Beretta, saying the gun did not have the proper warnings or a safety mechanism that stops the gun from being fired without the magazine in place.

the new Berettas has all kinds of warnings say that they will still fire without the mag, so my question is how old was the beretta and how could the manufacturer be blamed for some one elses mistake.

There is no legal requirement to have anything resembling common sense for you to file suit against someone.

If I had $35 in my pocket I could drive down to the court tomorrow morning and file suit against you, say for posting a picture of a holster that gave me bad dreams.
Doesn't have to pass a common sense test, doesn't have to have any basis in fact.
Mind you when it got ot the judge that might cost me some time and money but thems the facts

Seems as if our government (at all levels) is a little shy of common sense these days. And unfortunately a number of sheeple are unwilling to take responsibility for their own lives. :(

thats all true, and you both are right, people not only dont but they also dont want and they think someone else is always to blame but themselves. and it makes me a little bit pissy when people dont take responsibility for they actions. just me ranting sorry

It's called the "Deep Pockets" theory of law. Throw a lawsuit out there and see if someone will pay just to avoid the hassle of going to court.
Some twenty years or so ago a motorcycle club in California threw a poker run. There was some guy on a new Suzuki who managed to drop his bike in a corner. He sued the motorcycle club for having a run with a corner with dirt in it. He sued the State for designing a corner that would accumulate dirt. he sued the County for not keeping the corner clean. And, last but not least, he sued Suzuki for building a motorcycle that would fall over in a corner with dirt in it. Everyone told him to go to hell and learn how to ride a motorcycle except the County. The County paid twenty thousand dollars plus the cost of fixing the bike just to avoid going to Court. Guess they figured it would cost them more than that fighting it.
It sucks, but that is what our judicial system has come down to. :mad:

I know people get greedy and sue for some of the dumbest crap,I dont understand how they sleep good at night.

Your version of common sense is totally different than mine and it should be. Because we where both raised with different values, experiences et.

Common sense has nothing to do with law suits. Money has to do with law suits. Responsibility has nothing to do with law suits. Money has to do with law suits. And every once in a while proving a point has to do with law suits.

I hate the kind of people who bring a law suite just for financial gain. Like Jizzle said however, sometimes it is necessary to prove a point or right a wrong. I think what people here are calling a lack of common sense is actually parasitic behavior: The leeches of society who to make money from their own stupidity at the expense of others using our legal system.
